Both the Internal Revenue Service and the Department of Labor have ambitious regulatory agendas for the coming year.  DOL guidance that will permit the use of a “window” period for providing the participant investment chart and other disclosures required under ERISA §404(a)is expected any day. Additional guidance to look for from the DOL  includes new rules for benefit statements, a mandate for a “guide” to accompany 408(b) disclosures as well as proposed regulations redefining who is an ERISA fiduciary. The IRS is expected to soon expand the available correction options under EPCRS, address the use of forfeitures in safe harbor plans and issue guidance on mid-year safe harbor plan amendments. These proposals will significantly impact third party retirement plan administrators and their clients. Craig P. Hoffman, ASPPA’s General Counsel and Director of Regulatory Affairs, will discuss what to expect in 2015 and how to prepare for what is coming.
